Consignor Agreement
Your item(s) will be displayed for a minimum of three (3) months from the date it is put on the sales floor. The first month at full price, the second month at 15% discount, and the third month at 50% discount. It is the discretion of the Consignee to keep items displayed shorter or longer than three months or for the season that they are suited for.
Consignee agrees to display the agreed upon item(s) in the business for a maximum duration of 180 days (approximately 6 months) from the consignment date. Credit for sales will be accrued through the 180-day period.
The Consignor and Consignee agrees to the following:
A split of the consignor percentage as listed below when the item sells in the form of store credit or a check. Posh Consignment Shoppe does not issue checks or pay for items before they have sold.
Items priced $1.00-$50.00 - 30% to consignor/70% to consignee
Items priced $51.00-$150.00 - 40% to consignor/60% to consignee
Items priced $151.00+ - 50% to consignor/50% to consignee
Payment for sold items will be disbursed to Consignor by check and mailed to the account holder to the address on the account file. There is a $1 handling fee for checks that are mailed out.
Posh Consignment Shoppe will charge a $0.50 on the price of the item as a processing fee for all items accepted and sold.
The Consignee agrees to sell merchandise that is in agreed upon condition and meets the selection standards of the consignee. Please do not be offended if some items are not accepted for consignment based on brand, value, quality, or condition.
The consignee reserves the right to set pricing for merchandise and have periodic sales and markdowns.
Consignor agrees to leave accepted merchandise with Consignee for a minim period of 90 days (3 months). Do not expect to earn any consignment monies earlier than 60-90 days after items are brought in.
Consignment period shall begin the day merchandise is priced and put on display by Consignee. Average processing times from day of drop-off are approximately 4 weeks.
At the end of the Consignment Period, Consignor shall: Arrange to have the merchandise picked up from Posh Consignment Shop, any time after the 90-day sale period, should the Consignor desire to retrieve unsold merchandise after the 90 days from the processing date.
After the minimum 90-day period the Consignee may donate the remaining merchandise (priced under $50.00) at the Consignee’s discretion with no obligation to Consignor. (Unsold items priced below $50.00 will be donated to a charity after the donation date has expired or at the discretion of the Consignee, without exception. Unsold items priced $50 and higher are typically held on the floor up to a period of 180+ days. These items can be picked up at the discretion of the consignor any time after the 90-day sales period, and the consignor will be contacted when the consignee decides to remove them from the sales floor. If the consignor cannot be reached for pickup of the item, the consignee reserves the right to move the item on for donation.
The consignor may also use accrued credit towards the purchase of items in the store.
Unclaimed accounts below $50 will become the property of POSH Consignment Shoppe after 1 year if no account activity is observed. Account activity includes bringing items in for consignment, using store credit for purchases, and/or receiving a consignment check at anytime within a period of 12 months in a calendar year.
Consignor is not able to retrieve dropped off merchandise after signing of this agreement without verbal consent from Posh Shoppe Management until after the minimum 90-day sales period. Items picked up before the 90-day sales period there will be a $3.00 per item charge for each item retrieved.
Merchandise is left with Consignee at Consignor’s risk.
POSH Consignment Shoppe IS NOT liable for loss of consigned articles through FIRE, THEFT, VANDALISM, NATURAL DISASTERS, or IN-STORE DAMAGE. Consignor agrees to indemnify, defend, and hold harmless Posh Consignment Shoppe and its officers, directors, agents, and employees from and against any and all demands, claims, and damages to persons or property, losses and liabilities, including reasonable attorney’s fee, arising out of or caused by Consignor or its attendee’ negligence or willful misconduct.
Consignor warrants to Consignee that the merchandise consigned pursuant to this agreement are not in violation of any trademark, copyright, other proprietary right of third parties or that merchandise is stolen goods from other parties.
Consignee reserves the right to assist police authorities of suspected illegal trade of merchandise received from Consignor.
If a dispute between the consignor and consignee occurs, both agree to negotiate in good faith, with professionalism and maturity. If negotiation is not successful, the dispute will be mediated. If the mediation is not successful, binding arbitration will resolve this dispute.
Consignor hereby agrees to indemnify and hold harmless the Consignee from all damages, suits, litigation, awards, and costs, including but not limited to attorney’s fees, which arise out of the display or sale of the consigned merchandise for any reason whatsoever, including but not limited to civil or criminal suits over the authenticity, legality, ownership, infringement or copyright or trademark of any other claims or litigation.
This agreement may not be modified unless otherwise instructed/approved by Consignor and Consignee in writing and signed by both parties. All reasonable disputes will be directed to the business Owner and will be handled accordingly.
